Major developers and owners count on James E. Davies ("Jed") to help them with their development, use and ownership of real property.  Over the past ten years, Jed has also successfully defended owners, managers, developers, and general contractors in actions alleging defective workmanship, including structural failures, building envelope/curtain wall failures, and mechanical system failures in large-scale residential and commercial properties in New York City and elsewhere.

Jed has established a reputation as a leading defender of construction and environmental claims.  His practice encompasses the contractual and common law rights of all parties involved in construction and the use of real property including developers, contractors, design professionals, equipment and material suppliers and end users of the construction such as condominium and cooperative apartment owners.

Among Jed’s many notable results are:

  • Jed successfully defended the owner of Bianca Jagger’s Park Avenue rental apartment, obtaining a dismissal of claims that mold in her apartment caused her to suffer a myriad of injuries.  Bianca Jagger v. Katz Park Avenue Corp., 33 Misc.3d 139(A) (App. Term, 1st Dep’t 2011)
  • Jed also won summary judgment in favor of the sponsor of a luxury Park Avenue condominium in a case where the court found that the unit owner failed to submit sufficient evidence to support its multi-million dollar property damage and lost market value claim. Kerusa Co. LLC v. W10Z/515 Real Estate Limited Partnership, 50 A.D.3d 503 (1st Dep’t 2008)

Jed began his career in government service representing the City of New York enforcing civil and criminal violations of the New York City housing, environmental and health laws.  He also defended the City in civil actions concerning its use and ownership of real property.
